Understanding TPD

TPD refers to the Tobacco Products Directive (Tobacco Products Directive 2014/14/EU (TPD)), a regulatory framework developed by the EU to govern tobacco products, their marketing practices, and consumer sales methods. Its primary objective is to enhance health protection and awareness regarding tobacco products. TPD encompasses all facets of tobacco production and retail, including manufacturing processes, sales locations, display methods, packaging requirements, and sales procedures.

These regulations extend to all tobacco products such as rolling tobacco, cigarettes, cigars, as well as vaping devices and e-liquids. The directive ensures that ingredients undergo testing before reaching consumers and mandates their disclosure on product packaging. TPD also governs where tobacco products may be used and regulates their taxation.

TPD's Application to Vaping

Vaping products remain categorized as tobacco products despite not containing actual tobacco leaves. This classification exists because most nicotine used in e-liquids is extracted from tobacco plants, which naturally contain the highest nicotine concentrations. While synthetic nicotine alternatives now exist, any nicotine-containing product still falls within TPD regulatory scope.

Implementation Timeline

The TPD was established in May 2014 and became enforceable law on May 20th, 2016. This meant vaping retailers needed to clear all non-compliant inventory before this deadline. Consequently, some previously available brands may no longer be accessible, and e-liquid sales methods have evolved.

Key Regulations and Vaping Impact

Several regulations primarily affect e-cigarette capacity and e-liquid sales methods. However, most aspects remain unchanged from a consumer perspective. The primary modification involved mandatory labeling requirements for e-cigarette products.

E-cigarette tanks, including pod systems and disposable vapes, are limited to a maximum 2ml e-liquid capacity.
• Nicotine-containing e-liquid bottles cannot exceed 10ml maximum size.
Maximum nicotine strength is capped at 20mg (20mg nicotine per milliliter of e-liquid), contrasting with the US market which permits up to 50mg.
All nicotine-containing e-liquids must utilize child-resistant packaging.
Products cannot include caffeine or taurine ingredients.
Packaging must clearly indicate nicotine content and warn that nicotine is an addictive substance.
All e-cigarettes and e-liquids require MHRA approval before market availability.
